1. Introduction

These Terms of Service ("Terms") govern your use of the Sei Habits mobile application (the "App") operated by Individual Entrepreneur Arsenii Pomazkov ("we," "us," or "our").

By using this app, you agree to the collection and transmission of information about your habits (including habit names, reflections, and skip reasons) to our analytics provider for app improvement purposes.

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

2. Eligibility

You must be at least 13 years old to use the App. By using the App, you represent and warrant that you meet this age requirement.

2.2 Geographic Availability

The App is primarily intended for users in the United States, United Kingdom, Canada, and Australia. Use from other locations may be subject to local laws and regulations.

3. License and App Usage

3.1 License Grant

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.

3.2 Permitted Uses

You may use the App to:

  • Record mood and reflections

4. User Content and Data

4.1 Your Content

You retain ownership of all content you create in the App, including:

  • Habit tracking data
  • Personal reflections and notes
  • Mood entries
  • Custom settings and preferences

4.2 Analytics and Data Collection

By using the App, you acknowledge and agree that:

  • Information about your habits, including habit names, planning context, skip reasons, and reflection content, will be collected and transmitted to our analytics provider (PostHog)
  • This information is used to improve the app experience and develop new features
  • Currently, you cannot opt out of analytics collection within the app
  • Your analytics data may be retained by PostHog according to their data retention policies

4.3 Local Storage

All your personal data is stored locally on your device. We do not store, access, or back up your personal habit data on our servers.

4.4 Data Responsibility

You are responsible for:

  • Backing up your data if desired
  • Understanding that uninstalling the App will delete your local data
  • Ensuring your device security to protect your personal data

4.5 Content Standards

When creating content in the App, you agree not to:

  • Include harmful, offensive, or inappropriate content
  • Violate any laws or third-party rights
  • Include personal information of others without consent

5. Subscriptions and Payments

5.1 Subscription Plans

The App offers subscription plans including:

  • Monthly subscription
  • Annual subscription
  • 7-day free trial period

5.2 Payment Processing

  • All payments are processed through Apple's App Store
  • Subscriptions automatically renew unless cancelled
  • You can manage subscriptions through your Apple ID account settings

5.3 Free Trial

  • New users receive a 7-day free trial
  • Your subscription will automatically begin after the trial period unless cancelled
  • You can cancel during the trial period without charge

5.4 Billing and Renewal

  • Subscriptions are billed to your Apple ID account
  • Automatic renewal occurs 24 hours before the current period ends
  • Your account will be charged for renewal within 24 hours prior to the end of the current period

5.5 Cancellation

  • You can cancel your subscription at any time through your Apple ID account settings
  • Cancellation takes effect at the end of the current billing period
  • No refunds for partial periods

6. Refunds

6.1 Apple App Store Refunds

  • All refund requests must be made through Apple's App Store
  • Refunds are subject to Apple's refund policy
  • We do not process refunds directly

6.2 Refund Policy

  • Refunds may be available for accidental purchases
  • Technical issues will be addressed through support before considering refunds

7. Intellectual Property

9. Analytics and Improvements

10. Disclaimers and Limitations

11. Limitation of Liability

13. Termination

17. Miscellaneous

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us.

17.2 Severability

If any provision of these Terms is found unenforceable, the remaining provisions remain in effect.

Failure to enforce any provision does not constitute a waiver of that provision.
